1. General & Scope of Agreement These Terms of Service (“Terms”) govern the contractual relationship between Rohr-Frei Kanal Schmitt GmbH (“Company”, “we”, “us”, or “our”), operating under the brand name Clearflushservice, and any customer (“Customer”, “you”) ordering customized on-site toilet and drain unblocking services via our website www.clearflushservice.com.

By placing an order, booking a service appointment, or remitting payment on our website, you expressly agree to be bound by these Terms, as well as our Privacy Policy and Legal Notice (Impressum). These Terms are structured in accordance with German civil law (Bürgerliches Gesetzbuch – BGB) and applicable European Consumer Protection Directives.

2. Geographic Service Area Our customized on-site plumbing and unblocking services are offered and rendered exclusively to customers located within eligible regions of Europe. We do not offer or fulfill service requests for addresses outside European territories.

3. Age Limit & Eligibility Our website and services are intended exclusively for individuals who are at least 18 years of age and legally capable of entering into binding contracts. By using our site and booking services, you confirm that you meet this legal age threshold. Minors are strictly prohibited from submitting payment transactions or placing service bookings.

4. Billing Terms & One-Time Sale Policy

  • One-Time Purchase: All services offered on www.clearflushservice.com are sold strictly on a one-time purchase basis. We do not operate, offer, or charge any recurring subscriptions, automatic renewals, recurring membership fees, or hidden periodic charges.
  • Payment Processing: Each order corresponds to a distinct, single-instance customized on-site service appointment. You will only be billed the specific total amount shown and explicitly agreed upon at checkout for that individual transaction.
  • Payment Provider: Payment processing is securely handled via Stripe (Stripe Payments Europe, Ltd.). Payments are charged immediately upon order confirmation. Accepted payment methods are clearly displayed at checkout.
  • Currency & VAT: All prices are quoted in Euros (€) and include statutory German Value Added Tax (VAT ID: DE320926068).

5. Right of Withdrawal & European Consumer Exceptions As an EU consumer, you generally possess a statutory 14-day right of withdrawal for distance contracts under EU Consumer Rights Directive (2011/83/EU) and § 355 BGB.

  • Exception for Urgent On-Site Repairs/Maintenance: Pursuant to § 356 (4) BGB and Article 16(h) of the EU Directive, the statutory right of withdrawal does not apply to contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repairs or maintenance.
  • Service Completion: Once an on-site unblocking service has been fully performed following your explicit prior request and acknowledgment, your right of withdrawal expires.

6. Customer Obligations & On-Site Performance To enable proper performance of customized unblocking services, the Customer must ensure:

  • Accurate address, contact details, and descriptions of the drainage issue are provided at booking.
  • Unobstructed, safe access to the property, plumbing fixtures, and affected drainage systems at the scheduled appointment time.
  • Disclosure of any prior chemical drain cleaners used or known pre-existing structural pipe damage.

7. Intellectual Property Rights All intellectual property rights associated with www.clearflushservice.com—including but not limited to the brand name Clearflushservice, corporate name, website design, text content, software, page layouts, graphic illustrations, photographs, and media assets—are the exclusive property of Rohr-Frei Kanal Schmitt GmbH or used under valid royalty-free/original licensing.

All photographs and visual media on our website are strictly original works or copyright-free assets. Unauthorized reproduction, copying, distribution, scraping, or commercial exploitation of any site media or text without prior written authorization from Rohr-Frei Kanal Schmitt GmbH is strictly prohibited.

8. Limitation of Liability & Warranty We warrant that our services will be executed in a professional, workmanlike manner in accordance with recognized technical standards. Statutory warranty rights (Gewährleistung) under German civil law apply.

Rohr-Frei Kanal Schmitt GmbH shall be held liable for damages resulting from intent or gross negligence. Liability for simple/minor negligence is excluded, except in cases involving injury to life, body, or health, or breach of essential contractual obligations (Kardinalpflichten).

9. Applicable Law & Jurisdiction These Terms shall be governed by and construed under the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers residing within the European Union, mandatory statutory consumer protection laws of your country of residence remain unaffected. Jurisdiction for any legal claims shall be determined in accordance with applicable statutory regulations, with the primary place of registration for Rohr-Frei Kanal Schmitt GmbH being HRB 14900 (District Court of Aschaffenburg, Germany).
